GAAR: India May Not Go For Retro-Taxing Of Overseas M&A

A committee which was formed to give recommendations on the implementation of the controversial general anti-avoidance rules (GAAR) provisions in India released its draft guidelines Thursday night. The draft guidelines have clarified that the GAAR will not be applied retrospectively.

GAAR, which was introduced in the budget in March, has been much criticized by the industry and investors for its anti-investment friendly provisions. The new tax rules, intended to eliminate tax evasion by companies by routing their investments through tax havens, lacked clarity in several aspects and investors feared its misuse.

The provisions in GAAR like retro-taxing created panic among investors that reflected in Indian capital and Forex markets through the high foreign fund outflow. Though the government deferred its implementation by a year to 2013, it virtually spoiled the investor sentiment towards the economy.

In the draft guidelines issued Thursday, the government sought to allay the investors' concerns over retro-taxing and other issues.

On Invoking the GAAR and Retro Taxing provisions: The ministry's draft guidelines clarify that there won't be any retro-taxing and GAAR provisions will be invoked only if a Foreign Institutional Investor (FII) opts to take advantage of tax treaties.

"Where an FII (foreign institutional investor) chooses to take a treaty benefit, GAAR provisions may be invoked in the case of the FII, but would not in any case be invoked in the case of the non-resident investors of the FII," says the draft guidelines.

The ministry has also suggested having an income threshold for invoking GAAR while making clear that "the provisions of GAAR will apply to the income accruing or arising to the?taxpayers on or after 01.04.2013."

Interplay between SAAR and GAAR: Allaying concerns that there can be interplay between the Anti-Avoidance Rules (SAAR) and Specific General Anti-Avoidance Rules (GAAR), the draft guidelines said: ?"While SAARs are promulgated to counter a specific abusive behavior, GAARs are used to support SAARs and to cover transactions that are not covered by SAARs. Under normal circumstances, where specific SAAR is applicable, GAAR will not be invoked. However, in an exceptional case of abusive behavior on the part of a taxpayer that might defeat a SAAR, as illustrated in Example No. 16 in Annexure E (or similar cases), GAAR could also be invoked." ?

On the Application of Section 96(2): One of the contentious provisions in GAAR was that even if only a part of the business arrangement is to obtain a tax benefit, the tax authorities will treat the whole arrangement as an impermissible arrangement, according to section 96(2).

However, now the draft guidelines recommend that "where only a part of the arrangement is impermissible, the tax consequences of 'Impermissible Avoidance Arrangement' will be limited to only that part of the arrangement."

The draft guidelines are not yet seen by Prime Minister Manmohan Singh, who assumed the charge of the Finance Ministry after Pranab Mukherjee resigned from the post. Finance ministry sources have revealed that the guideline will be finalized in consultation with the Prime Minister. However, with Singh making it clear that he would make all efforts to get back the foreign funds and revive economic growth, the concerns over the provisions of GAAR are expected to be addressed soon.?

Analysts expressed satisfaction over the government move to clarify on GAAR.

"Some clarifications are a welcome step. It remains to be seen how the guidelines are implemented," said N. C. Hegde, a Mumbai-based partner at Deloitte Touche Tohmatsu India, according to a Bloomberg report.

The government's initiative to sort out the concerns over GAAR is crucial in regaining the FII confidence. Experts feel though there still exists some doubts on the provisions of the controversial act, steps taken now are in right direction towards clearing them.?

(AP) ? In the six years he's managed a sanctuary for abused and orphaned chimpanzees, South African conservationist Eugene Cussons is from time to time called on to comment when an ape somewhere in the world attacks a human. Cussons says he always could pinpoint a moment of taunting or perceived aggression that could have set off the quick and powerful animals.

This time, though, the attack was at his own Jane Goodall Institute Chimpanzee Eden in South Africa. And Cussons, host of the Animal Planet show "Escape to Chimp Eden," is without an explanation.

In telephone interview Saturday, Cussons said he would have to wait until the severely injured victim, a University of Texas at San Antonio graduate student inspired by famed primatologist Jane Goodall to study chimps, was well enough to provide details about Thursday's attack.

It was the first such attack since Cussons, working with Goodall's renowned international institute, converted part of his family's game farm into the sanctuary in 2006.

"You can train for it, you can do your best to prepare," Cussons said. "But when it actually happens, it's shocking and traumatic for everyone."

Cussons's team quickly evacuated the dozen tourists to whom Andrew F. Oberle had been giving a lecture and tried to separate the chimps from Oberle. In the end, Cussons, who was himself attacked by a chimp as he tried to pull it off Oberle, took the extreme step of firing into the air, scaring the animals away.

Oberle was bitten repeatedly and dragged for nearly a kilometer (half mile). Cussons said one of the chimps was injured in the scuffle, and he was awaiting a veterinarian's report to determine the nature and extent of the injury. No one else was hurt.

Male chimps can stand up to 1.7 meters (5 feet, 7 inches) tall and weigh about 70 kilograms (154 pounds), according to the Jane Goodall institute. The two chimps that attacked Oberle were male, though the sanctuary's website did not say how large the animals were.

Cussons said it was the first time he had asked Oberle to speak to visitors. The student had arrived last month for a follow-up visit after an extended stay to observe the chimps a year or so ago, Cussons said. As a researcher, Cussons said Oberle had been trained to ensure he understood how the animals might behave and knew to keep a safe distance. Cussons said Oberle was given additional training before addressing the tour group.

Cussons said Oberle broke the rules by going through the first of two fences that separate humans from the chimps. The chimps then grabbed him and pulled him under the second fence, which is electrified. Cussons said it was unclear why Oberle had moved so dangerously close.

Mediclinic Nelspruit hospital said Saturday that the 26-year-old Oberle remained in critical condition in intensive care. Oberle underwent surgery at the hospital Thursday.

Oberle's uncle, Carl Oberle, told The Associated Press on Saturday that Oberle's parents were on their way to South Africa.

"It is a hard time right now for our family," said Carl Oberle, who did not want to discuss details of his nephew's condition.

He said his nephew had returned to South Africa to study the animals that were his "passion." He noted the young man previously worked for several years as a camp counselor at the St. Louis Zoo.

"He was a real inspiration to the children he worked with and extremely well-liked and respected," zoo spokeswoman Susan Gallagher said Saturday.

Oberle's mother, Mary Flint, said Friday that her son knew the risks of working with chimps and would not want them blamed for the attack.

"He adored them," she said. "Since he was a little boy he just loved them, and I just have faith that ... when all is said and done, he's going to go right back into it."

The sanctuary has been closed to tourists since the attack, while government and police officials investigate. The Jane Goodall Institute South Africa is conducting its own investigation.

"Everyone at Chimp Eden is hurting," Cussons said, saying the thoughts of staff members were with Oberle and his family.

Cussons said the two chimps that attacked Oberle, Amadeus and Nikki, had been isolated since the attack. He said they were calm and exhibiting remorse, which he said chimps show by behaving submissively.

Human-animal contact is kept to a minimum at the sanctuary, designed as a haven for chimpanzees that have been rescued from elsewhere in Africa. Some lost their parents to poachers in countries where they are hunted for their meat or to be sold as pets, and others were held in captivity in cruel conditions.

According to the sanctuary's website, one of the chimps involved in the attack, Amadeus, was orphaned in Angola and brought to South Africa in 1996, where he was kept at the Johannesburg Zoo until the sanctuary opened. The other, Nikki, came from Liberia in 1996 and also was held at the zoo until becoming one of the first chimps at the sanctuary. Before arriving in South Africa, Nikki, whose parents were killed for their meat, had been treated like a son by his owners, who dressed him in clothes, shaved his body and taught him to eat at a table using cutlery, the website said.

New Mayan text confirms December 2012 end for calendar (+video)

Researchers say that a newly discovered Mayan text confirms that December 21, 2012 was an important date for the classic Mesoamerican civilization. But they find no mention of any kind of doomsday.

"This text talks about ancient political history rather than prophecy," Marcello Canuto, the director of Tulane University Middle America Research Institute, said in a statement. "This new evidence suggests that the 13 bak'tun date was an important calendrical event that would have been celebrated by the ancient Maya; however, they make no apocalyptic prophecies whatsoever regarding the date."

The Mayan Long Count calendar is divided into bak'tuns, or 144,000-day cycles that begin at the Maya creation date. The winter solstice of 2012 (Dec. 21) is the last day of the 13th bak'tun, marking what the Maya people would have seen as a full cycle of creation.

New Age believers and doomsday types have attributed great meaning to the Dec. 21, 2012 date, with some predicting an apocalypse and others some sort of profound global spiritual event. But only one archaeological reference to the 2012 date had ever been found, as an inscription on a monument dating back to around A.D. 669 in Tortuguero, Mexico. [End of the World? Now, researchers exploring the Mayan ruins of La Corona in Guatemala have unearthed a second reference. On a stairway block carved with hieroglyphs, archaeologists found a commemoration of a visit by Yuknoom Yich'aak K'ahk' of Calakmul, the most powerful Mayan ruler in his day. The king, also known as Jaguar Paw, suffered a terrible defeat in battle by the Kingdom of Tikal in 695.

Historians have long assumed that Jaguar Paw died or was captured in this battle. But the carvings proved them wrong. In fact, the king visited La Corona in A.D. 696, probably trying to shore up loyalty among his subjects in the wake of his defeat four years earlier. [See images of the carvings]

FTC's ability to thwart online deception extremely limited: report

The Federal Trade Commission, established almost a century ago to investigate unfair and deceptive business practices, appears to be rather poorly suited for policing the vast and changeable online world, suggests a report from ProPublica. The FTC is secretive about its methods, but a cursory examination by the non-profit, investigative news organization shows that the agency's capabilities are limited in fundamental ways.

Despite the FTC?employing nearly 1,200 employees, the relatively new department established to cover the ?mobile sector of commerce comprises just six people?? three of whom are from the legal department.?Furthermore, the people who ostensibly oversee commerce involving the hundreds of millions of phones in this country ? along with apps, services and carriers?? are restricted in both the hardware and software they use.

BlackBerry phones?are used at the FTC and other government agencies?for security reasons, but iPhone or Android devices and the apps they run are kept in a basement lab, which very likely makes real use of them impossible. Several employees interviewed admitted to using personal devices to do their work. The FTC itself doesn't seem to see the necessity of providing its employees with the means to do their job:

The interview with [Mobile Technology Unit director Patricia] Poss was conducted in an office on the third floor of the FTC?s headquarters, with an FTC spokeswoman on hand. When Poss was asked whether it wouldn?t make sense for the director of the Mobile Technology Unit to have a government-issued iPhone or Android, the spokeswoman, Claudia Farrell, interceded.

?He?s trying to get you to bitch, Patti. Don?t do it.?

The Internet inside the agency, too, is restricted. Many sites, including Apple's App Store, simply cannot be accessed from the government's network. The report's writer compares it to telling cops they can't go to high-crime neighborhoods.

So it comes as no surprise that?when Internet-based companies are found to be deceiving or mistreating their customers, it's usually a young security wonk or other non-public entity that makes the discovery. Or, as?in a recent case where Google was found to have collected an enormous amount of private data using its Street View cars, the mistreatment was only discovered after another government took the matter in its own hands (Germany, in this case), and the indictment had global effects.

That's not to say they don't know they could be doing more, as the agency's chief technologist, Edward Felten, tells ProPublica:

We could for sure do more if we had more people ...?There are a lot of opportunities that we have to let go by because we don?t have the people to seize them ? opportunities to measure and evaluate what?s happening every day in people?s computers and phones.

When the FTC does find itself in a position to regulate Internet and mobile companies,?the process is often so slow compared to fast-moving tech industry, that by the time the case is made and any punishment doled out, the offense (or even the offender)?is already?long forgotten.?For instance, the ProPublica report says, the FTC began legal proceedings against Myspace in 2009 ??when that social network was in decline ? and only wrapped it up and fined the company in May of this year.

The agency is simply outgunned, but it refuses to gear up, says ProPublica. Despite being outmaneuvered on both sides?? on one by large companies dancing around regulations, on the other by private or individual investigators doing their job for them?? they are not requesting more money or manpower, or?claiming very reasonably that they are more necessary than ever.

But as ProPublica points out, those who ask do not always receive:

FTC officials are reluctant to talk about their lack of funding, partly because public whining, especially during hard economic times, is infrequently rewarded. It?s also politically unwise. A vocal portion of the electorate believes the government and its regulatory arms have too much money and power as it is. Additionally, the FTC is trying to keep the tech industry honest by hinting that the feds are watching everything. It does not help if Silicon Valley realizes the FTC possesses just a handful of iPhones and Androids that are kept under lock and key in the basement.

The tech industry may not have great reason to fear the FTC at the moment, but it is still under careful surveillance by independent organizations like the EFF and other?privacy and business watchdogs. They may not have the ability to bring the weight of the federal government to bear on offending companies, but they can at least provoke the no less serious threat of public scrutiny.

(AP) ? A popular Polish board game based on the hardships of communism is now available in international editions.

Poland's National Remembrance Institute released the Polish version of the game ? called "Kolejka"? last year. The goal was to teach youth about frustrations and shortages during the decades of communism, which Poland shed in 1989.

Although referred to as "Communist Monopoly" the game doesn't let players collect rent or buy land. Instead, they often get frustrated because they can't buy anything even after waiting in long lines. "Kolejka" means line, or queue.

Game developer Karol Madaj said Thursday that he chose that theme because standing in lines was a common experience under communism. He also knew he could "transform a queue into a board game, arrange the pawns in lines and make players elbow their way to the shop door."

The game has been a hit.

How did tea become hip? Hold on a minute. Things have improved in recent years or perhaps even decades, but one could still argue that tea is suffering from an image problem. You know the one ? staid tea rooms frequented by ladies of a certain age, neatly trimmed crustless sandwiches, and so on. Not to mention that for many people tea still conjures up visions of black dust crammed into ultra-cheap tea bags, resulting in a beverage that leaves much to be desired.

This model of tea culture, such as it was, is gradually dwindling, to be replaced by one that could reasonably be called hip. But how did it all come to pass? For starters, it?s worth noting the efforts of latter day tea pioneers like James Norwood Pratt and David Lee Hoffman, who began fighting the good fight for ?good? tea long before tea hit it big.

I would also make the cautious argument that tea rode in on the same horse that brought us an increased interest in food culture in general, that ongoing trend that gave us such dubious terms as ?foodie.? Hardcore food people might cringe at the notion, but the rise of cable TV and specifically the Food Network, which got underway in 1993 and which now reaches nearly 100 million households, certainly can?t have hurt.

Tea was apparently already hip by this time, if we?re to believe a 1994 New York Times article bearing the unambiguous headline Evolution Of Tea: Now It?s Hip. Written by regular contributor Florence Fabricant, it kicks off with the slightly cringeworthy (maybe it?s just me) statement that ?Tea is becoming the coffee of the 90?s.?

Fabricant noted that tea is popular all over the country, even in Seattle, that bastion of coffee culture. She also noted that sales have increased nearly eight percent in the previous year and cited figures that specialty tea sales will jump from $415 million in 1993 to $531 million, in 1997. Though the article noted that much of the tea consumption in the U.S. is of ready-to-drink iced tea, much of it was nonetheless devoted to talking with tea merchants who were part of the rush toward selling higher quality mostly loose leaf teas.

As with so many general interest articles about tea, there?s a brief Tea 101 and a requisite section on how to make a good cup of tea. Which is all well and good, but one small demerit is in order for perpetuating the popular myth that tea can be leached of most of its caffeine by giving the leaves a 30 second rinse.

'Game Of Thrones' Replaces George W. Bush Look-Alike

Former President George W. Bush has lost his headagain.

"Game of Thrones" made headlines earlier this month when it was revealed that one of the heads lining the walls of King's Landing in the season one finale resembled the former U.S. commander-in-chief. HBO responded by immediately issuing an apology, pulling the episode from their streaming and online services, and even halting home-video shipments of the season.

Now, the episode is back online, and Bush's head has been erased, the Washington Post reports. In his stead is a generic, weak-chinned Westerosi, with a sad frown that pretty much epitomizes the unexpectedly dramatic situation.

When word first hit about the likeness of Bush's severed head appearing on "Thrones," HBO officials were quick to release an apologetic statement: "We were deeply dismayed to see this and find it unacceptable, disrespectful and in very bad taste ... we made this clear to the executive producers of the series who apologized immediately for this inadvertent careless mistake. We are sorry this happened and will have it removed from any future DVD production."

For their part, executive producers and co-showrunners David Benioff and D.B. Weiss — who first pointed out the resemblance to Bush in a DVD commentary track, which was then picked up and widely reported by an eagle-eyed Reddit user — followed suit with an apology of their own.

"We use a lot of prosthetic body parts on the show: heads, arms, etc. We can't afford to have these all made from scratch, especially in scenes where we need a lot of them, so we rent them in bulk," the pair said in a joint statement. "After the scene was already shot, someone pointed out that one of the heads looked like George W. Bush."

Well, no one can say the head looks like Bush now, can they? Then again, from the right angle, in the right light ...

Colonoscopy Prevents Colorectal Cancer Deaths | ISMH

Colorectal cancer is the third most common cancer and the fifth leading cause of cancer death in men worldwide.? The majority of colorectal cancers arise from adenomatous polyps, which can be detected with screening colonoscopy.? Previously, the investigators of the National Polyp Study (NPS), found that colorectal cancer can be prevented by colonoscopic removal of adenomatous polyps.? However, it has been unclear if the cancers prevented were those that had the potential to cause death.? Recently, Zauber and colleagues reported* the effect of colonoscopic polypectomy on mortality from colorectal cancer.? The researchers conducted a long-term prospective? study of the NPS cohort of patients to determine the mortality among patients with adenomas removed compared with the expected mortality from colorectal cancer in the general? population.?? The death rate of patients with adenomas was also compared with an internal control group of patients with nonadenomatous polyps.? Among 2,602 patients who had adenomas removed, 12 died from colorectal cancer over a median? period 15.8 years, compared with 25 expected deaths in the general population, suggesting a 53% reduction in mortality.? Mortality from colorectal cancer among patients with adenomatous polyps was similar to those with nonadenomatous during the first 10 years after polypectomy.? Thereafter, mortality increased for patients with adenomas, when strict surveillance was not organized by the study?s investigators.? The researchers concede several limitations of the study.? A small number of skilled endoscopists performed the colonoscopies, thus the observations may not be applicable to a community practice, for which the reported rates of colorectal cancer after polypectomy are higher than those reported in the NPS.? The results of the study may not be? representative of the general population, since the study was not a randomized, controlled trial.? In conclusion, the study?s findings further support the belief that colonoscopic removal of adenomatous polyps prevents colorectal cancer death.? The results also underscore the importance of longterm-term surveillance for patients after the initial removal of adenomatous polyps.? More randomized, population-based trials are necessary to determine the effectiveness of screening colonoscopy? on colorectal cancer mortality.

Program, Budget and Finance chair announces hearings structure

[Episcopal News Service] Diane Pollard, the chair of the Episcopal Church?s Joint Standing Committee on Program, Budget and Finance posted the following announcement on the committee?s blog June 24.

?During the past three months, members of the Joint Standing Committee on Program, Budget and Finance have been attending provincial synod meetings in order to present the Draft Budget of the Executive Council. During our presentations we announced the process for conducting hearings at the General Convention. We indicated that two of the three hearings would be conducted in a conversational form ? with individuals seated at round tables and engaging in conversation with members of the PB&F committee. At a recent provincial synod meeting concerns were voiced questioning if this form would satisfy the definition of an open hearing. We have looked into this and decided that all three of the hearings [scheduled for 12:30 p.m.-1:30 p.m. July 4, and 7:30 p.m.-9:00 p.m. July 6 and 7] will be conducted in the form of individual testimony.

?We appreciate the input that has caused us to decide on this change in our process. We hope that all who plan to attend the hearings will come prepared with statements that are clear and concise. Because of time constraints, we anticipate limiting individual comments to two minutes. I look forward to seeing you in Indianapolis.?

Thread: Sharon's custom porch swing... - Family Woodworking

I bought the plans for Norm's porch swing. My wife didn't care for the size so I had to lengthen it and make it deeper. Break out the drawing board! She is visiting her Mom and wanted photos so she could show her the swing before Sharon returns home on Thursday. Did I mention....I miss her? It's been a long 3 1/2 weeks! So here it is in white oak.

The seat slats aren't attached yet. I will finish them separately from the frame and then attach them. You can see the pre-drilled holes in the seat slats. I will screw the slats on with stainless steel screws, plug the holes with oak dowels and sand smooth. Then apply finish to the plugs.

Notice the only hardware that will be visible are the 4 stainless steel bow eyes. Even their mounting hardware is recessed and the holes plugged with glued oak plugs.

All the joints are mortise and pinned tenons except....the two middle seat supports which are trapped between the lower back rail and the front seat rail.

There are 15 vertical back slats but only 5 are glued. The middle slat and two at each end. Even with slow setting glue, to glue all 15 would be nearly impossible for this old guy to do solo.

If my count is correct there are 50 mortise and tenon joints in this swing. I learned to dearly appreciate my General International hollow-chisel mortiser, a sharp hollow-mortise chisel and a sharp bit!

It was quite the learning experience!

Egypt's new president gets down to business

CAIRO (Reuters) - Islamist Mohamed Mursi, Egypt's first freely elected president whose powers have been curbed by the military, toured his palatial new residence - where ousted leader Hosni Mubarak once lived - and began work on Monday to form a coalition government.

Declared winner on Sunday a week after a nail-biting run-off vote that pitted him against an ex-military officer, the Islamist faces the challenge of meeting sky-high expectations in a nation tired of turmoil while the economy is on the ropes.

But his campaign pledge to complete the revolution that toppled Mubarak last year but left the pillars of his rule intact will come up against the entrenched interests of the generals who have been in charge of the transition to democracy.

Shortly before the presidential vote, the newly elected Islamist-led parliament was dissolved by the army based on a court order and the generals issued a decree putting limits on the president's remit, which cuts into Mursi's powers to act, but exposing him to blame for any failures.

Further afield, his win has had an immediate impact beyond Egypt's borders, inspiring Islamists who have risen up against autocrats across the Middle East and swept to power in North Africa. Israel worries its peace deal with Egypt, never warm, will cool further. Palestinians in Gaza, however, are delighted.

Iran saw his election as an "Islamic awakening" - though Tehran and the Muslim Brotherhood follow different, often opposed forms of the faith. Its Fars news agency published an interview in which Mursi called for restoring severed ties to build strategic "balance". A Mursi aide said he gave the interview 10 days ago.

A security official said Mursi and his wife took a tour of their new home, once Mubarak's main residence - a dramatic change of fortunes for a former political prisoner whose group was pursued remorselessly during Mubarak's 30-year rule.

An aide said Mursi then went to the Defence Ministry for talks with the head of the military council Field Marshal Hussein Tantawi and the army-appointed Prime Minister Kamal al-Ganzouri for talks on steps towards forming a new government, a visit rich with symbolism about where real power lies.

As president, Mursi can appoint the cabinet. His aides say he has already reached out to politicians from outside the Brotherhood such as reformist Mohamed ElBaradei, who has yet to publicly respond. But legislative powers remain with the army while the parliament is dissolved, restricting his power to act.

One pressing concern - on which many Egyptians are likely to judge his performance - will to be to revive the economy. Monday's stock market rally, at least partly fuelled by relief that the vote and result passed off without violence, may encourage the new president, but he still has to prove to wary longer-term investors that Egypt is on the road to recovery.

Egyptian newspapers greeted Mursi's win over Ahmed Shafik, Mubarak's last prime minister, as a victory for the people, although many more liberal-minded Egyptians worry his conservative group will slowly whittle away at social freedoms.

"The revolution reaches the republican palace," wrote Al-Shorouk newspaper. Another, Al-Akhbar, quoted from Morsy's victory speech: "I am a servant of the people and an employee of the citizens". It is a sentiment widely spoken, this sense of, at last, perhaps having an Egyptian leader who can be "fired".

Celebrations in Cairo's Tahrir Square - theatre of the revolution that overthrew Mubarak - extended through the night. Some Brotherhood followers were still celebrating and a little surprised by their victory that broke a six-decade tradition of president's plucked from the military.

STREET PRESSURE

"It was a little surprising that the army acknowledged his win," said 40-year-old teacher Adel Mohamed who was in the square when the result was declared after a nail-biting week's wait since the vote. "The pressure from the street, from the revolution, will give Morsy strength to negotiate."

Those in Egypt and beyond who feared a win for Shafik might have spelled the end of the Arab Spring acknowledged a triumph for the popular will, and for the army which accepted it. From Syria's opposition came word that Cairo was again a "source of hope" for a people "facing a repressive war of annihilation".

But millions of Egyptians, and the Western powers, looked on with unease at the prospect of the long-suppressed Brotherhood making good on its dream of an Islamic state for the Arab world's biggest nation.

Israel has been particularly nervous, urging its neighbour to respect their peace deal. It worries that the Brotherhood's win will embolden Palestinian Islamists opposed to Israel.

"Darkness in Egypt," headlined Israeli paper Yedioth Ahronoth. Israeli Prime Minister Benjamin Netanyahu said he "respected" the result.

"Mursi's victory is most likely to strengthen the hand of Hamas in its fight against Israel because it will give it a moral boost," said political scientist Mustapha al-Sayyed, adding this could strain ties with Israel long used to the cool but steady relationship it had with Mubarak.

But the army, determined not to see its $1.3 billion in U.S. military aid a year jeopardised, will likely ensure ties are not undermined even if the relationship sours, diplomats say.

Pledging to uphold international treaties, in a gesture to Israel, Mursi said in his first televised address as president-elect that he would work with others to see the democratic revolution through.

"There is no room now for the language of confrontation," he said, a message addressed not just to the army but to the young, urban revolutionaries who launched last year's uprising only to see the Brotherhood dominate the political scene afterwards.

One of the most influential revolutionary youth groups greeted Mursi's win as a victory for last year's uprising.

"We have defeated the candidate of Mubarak's military state, the candidate of the corrupt 'deep state' that we are fed up with," said the April 6 Youth movement.

"Starting today we will work as one body for Egypt."

COMPROMISE

Western powers congratulated Mursi, who received a phone call from U.S. President Barack Obama, offering help.

The White House said in a statement: "The president underscored that the United States will continue to support Egypt's transition to democracy and stand by the Egyptian people as they fulfil the promise of their revolution."

Mursi may have little choice but to compromise with the army, and Brotherhood sources said a package of agreements discussed with generals last week could soon be announced.

The Brotherhood's political gains, first winning the biggest bloc in parliament and then running for president, had rattled the military. With the help of a Mubarak-era judiciary, the military council, SCAF, dissolved parliament on the eve of the presidential vote, then gave itself the legislative power.

Critics at home and in the West called it a "soft coup."

Senior Brotherhood officials say they have been negotiating in the past week to change some of that, though both sides deny any haggling over the result of the presidential vote itself.

"President Mursi and his team have been in talks with the military council to bring back the democratically elected parliament and other issues," Essam Haddad, a senior Brotherhood official, told Reuters on Monday.

Brotherhood sources told Reuters they hoped the army might allow a partial recall of parliament and other concessions in return for Mursi exercising his powers to name a government and presidential administration in ways the army approves of - notably by extending appointments across the political spectrum.

Military officials have confirmed discussions in the past few days but had no immediate comment on the latest talks.

Brotherhood officials have said they will press on with street protests to pressure the army but this, along with a number of other contentious issues including to whom and where Mursi swears his oath of office, could be settled soon.

The army wants Mursi sworn in on June 30, meeting a deadline it set itself for handing over Egypt to "civilian rule" - although the military's influence will go on long beyond that.

In North Carolina, a fight over sea levels and science

RALEIGH, N.C. ? When scientists at a state commission predicted that North Carolina's sea levels could rise 39 inches by 2100, coastal business and development leaders weren't alarmed at the prospect of flooding. They were outraged by the report itself.

They complained to state legislators, saying the projection could trigger regulations costing coastal businesses and homeowners millions of dollars.

The result is House Bill 819, a measure that would require sea level forecasts to be based on past patterns and would all but outlaw projections based on climate change data.

The bill, now under discussion by a legislative conference committee, has been ridiculed nationwide. It was mocked by comedian Stephen Colbert and savaged in a Scientific American blog post titled "N.C. Considers Making Sea Rise Illegal."

It has also focused attention on the political shift in North Carolina, where Republicans in 2010 won control of the state Legislature for the first time in a century.

The legislation would outlaw "scenarios of accelerated rates of sea level rise unless such rates are from statistically significant, peer-reviewed data and are consistent with historic trends."

Scientists and environmentalists say the bill would legislate science and inhibit research. Orrin H. Pilkey, a geology professor emeritus at Duke University, said making projections based only on past sea level changes is like limiting hurricane warnings to the precise spots where hurricanes have struck.

Stanley R. Riggs, an East Carolina University geologist and one of 19 scientists who made the 39-inch projection, said the bill represents "a criminally serious disregard for science."

The Science Panel on Coastal Hazards of the state Coastal Resources Commission consists of marine scientists, geologists and engineers who relied on tide gauges, satellite altimetry, storm records and geologic data. They cautioned that predicting long-term sea level change is "an inexact exact science," saying the report reflects "the likely range" of sea level rise due to global warming and the melting of ice shelves.

Because sea levels and scientific knowledge are advancing rapidly, Riggs said in an interview, the panel recommended recalculating sea level projections every five years.

The bill's backers issued their own projections, using data from tide gauges and carbon dioxide levels, and citing studies that project no or minimal sea level rise. They predict a rise of, at the most, 8 inches ? and contend that sea levels are actually receding in some coastal areas. They say the 39-inch projection would restrict economic development, send insurance rates skyrocketing and decrease coastal property values.

"It's a death sentence for coastal North Carolina," said Tom Thompson, who leads the coastal business group, known as NC-20 for its representation of 20 coastal counties. "It could quite frankly kill development on the coast."

Thompson, director of the Beaufort County Economic Development Commission, called the 39-inch prediction "dishonest statistically" and no better than a coin flip. In an interview, he dismissed climate change as "a phobia" pushed by environmentalists.

John Droz Jr., NC-20's science advisor, said commission scientists were "bent on promoting their personal political agenda." NC-20's projections "are entirely about the science" and have nothing to do with developers, or economics, Droz wrote in a letter to the News & Observer newspaper.

Republican state Sen. David Rouzer, a sponsor of the bill, did not respond to requests for comment. After the measure was endorsed by a state Senate committee June 7, Rouzer told reporters:

"If you're going to use science when you really can't validate it ? you're going to be implementing policy and rules and regulations that can have a very, very negative impact on the coastal economy of this state."

A spokeswoman for Gov. Bev Perdue, a Democrat, said the governor would not announce her position on the bill unless it was passed by the Legislature.

Biology professor Robert B. Jackson, who directs Duke University's Center on Global Change, warned a Senate committee earlier this month that denying rising sea levels puts coastal residents and property at risk of serious flooding.

"There are many things we can do something about if we use this data," Jackson said. "I don't see why taking into account the range of possible futures costs us money, compared to naively assuming the best-case scenario."

Riggs, the geologist, said the panel had preferred to report a range of projected sea level rises ? from 15 to 18 inches to 55 inches, based on each member's projections. But because the commission demanded an absolute number, the panel took the mean of the range, or 39 inches.

Comedian Colbert brought the debate to a national audience, wisecracking in a segment titled "Sea, No Evil" on the June 4 "Colbert Report": "If your science gives you a result you don't like, pass a law saying the result is illegal. Problem solved."

The bill has triggered lively debate on social media, websites and the letters page of the News & Observer. The paper's editorial board called the bill "a burst of legislative folly."

One letter, titled "Sea-Level Fiction," said the bill "reveals just how far the climate change-deniers and their anti-environmental, science-hating minions have penetrated" state government. Another, from an environmental technology professor at North Carolina State University, said: "We are the laughingstock of the nation."

In a recent full-page newspaper ad titled "The N.C. General Assembly wants to ignore science," the Southern Environmental Law Center said the sea level bill would "set a dangerous precedent of politicians telling scientists what data they may and may not use."
